
IUP Law Students and Lecturers Join the Judicial Review Team for the Government Administration Law at the Indonesia Mahkamah Konstitusi
Denpasar, Bali, February 20, 2026 – The Faculty of Law of Universitas Pendidikan Nasional (FH Undiknas) has officially filed a petition for judicial review of Law Number 30 of 2014 on Government Administration to theMahkamah Konstitusi of the Republic of Indonesia. This step represents FH Undiknas’ academic contribution in promoting legal certainty and restructuring norms in government administration, as well as its active involvement in the development of Indonesian law. The petition has been officially registered with the Mahkamah Konstitusi of the Republic of Indonesia under Case Number 66/PUU-XXIV/2026 and was recorded on February 12, 2026. Following its registration, the Mahkamah Konstitusi will proceed to examine and adjudicate the petition in accordance with the applicable procedural law. The petition was submitted collectively by members of the academic community of the Faculty of Law, Undiknas, together with representatives of village governance. The Petitioners consist of lecturers, students, and a village head.


From the lecturers of the Faculty of Law, Universitas Pendidikan Nasional, the Petitioners are Dr. Ni Gusti Agung Ayu Mas Tri Wulandari, S.H., M.H., CCL; I Putu Edi Rusmana, S.H., M.H.; and Putu Wahyu Widiartana, S.H., M.H. Meanwhile, from the students of the Faculty of Law, Universitas Pendidikan Nasional, the Petitioners are Putra Lorenzo, Kadek Jessica Aswanda Putri, Ayu Bang Bahari Ken Widyawati, and I Gusti Ayu Agung Anindya Prameswari Dewi. From the village government element, the Petitioner is I Nyoman Widhi Adnyana, S.Kom., M.Pd., Head of Kukuh Village, Tabanan Regency, Bali. This petition also concretely involves Kukuh Village, which serves as the community service village of the Faculty of Law, Universitas Pendidikan Nasional, thereby reflecting a direct connection between academic study and governance practice in the field. All Petitioners are represented by nine legal counsels who will appear before the Mahkamah Konstitusi. The norm being challenged concerns the phrase “state financial loss” in the Government Administration Law. FH Undiknas considers that the use of this phrase within the context of administrative law has the potential to create conceptual ambiguity and impact governmental practice. According to the Petitioners, such ambiguity may blur the boundary between administrative errors and criminal offenses, potentially creating legal uncertainty for government officials, particularly at the village level, who directly manage public finances and deliver public services. FH Undiknas expresses optimism that the petition will be accepted and seriously considered by the Mahkamah Konstitusi.


This optimism is based on the depth and maturity of the legal arguments presented, as well as the identified normative inconsistencies within the Government Administration Law that, from both academic and systemic perspectives, require clarification. Through this judicial review, the Petitioners emphasize that the primary objective is to clarify and firmly establish the boundary between the regime of State Administrative Law and criminal law, particularly in cases related to state financial losses such as corruption offenses. The Petitioners argue that state officials who operate under and comply with the Government Administration Law should not be placed under the shadow of criminal liability merely due to administrative errors or policy decisions, as often occurs in practice. With a clear boundary, administrative mechanisms can function optimally as instruments of correction and recovery, while criminal law remains proportionally applied to acts that genuinely fulfill the elements of a criminal offense. FH Undiknas hopes that the Mahkamah Konstitusi will provide constitutional clarification that strengthens legal certainty, encourages public officials to make responsible policy decisions, and fosters a professional, accountable, and just governance climate.
